Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, dashboards, and software made available by Bello Homes ("Bello Homes," "we," "us," or "our"), including the Bello Homes Owner Dashboard and any related applications (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Who we are

Bello Homes is a short-term rental management company headquartered in Raleigh, North Carolina. We provide management services for property owners and operate software tools that help owners view bookings, expenses, statements, and other financial information related to their properties.

2. Eligibility and accounts

You may use the Services only if you are at least 18 years old and capable of entering into a binding contract. Access to the Owner Dashboard is restricted to property owners and authorized representatives who have an active management agreement with Bello Homes, and to internal Bello Homes administrators.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

3. Your management agreement controls financial terms

The Services are an interface to information about your property. They do not by themselves create, modify, or replace the management agreement signed between you and Bello Homes. In the event of any conflict between these Terms and your signed management agreement, the management agreement controls with respect to fees, payouts, and the scope of services delivered.

4. Acceptable use

You agree not to:

• Access the Services in a way that exceeds the rights granted to you in your account.
• Reverse engineer, decompile, or attempt to derive source code from any Bello Homes software, except to the extent permitted by applicable law.
• Use automated tools to scrape, crawl, or extract data from the Services other than via documented APIs.
• Upload content that is illegal, infringing, malicious, or that contains viruses or harmful code.
• Interfere with or disrupt the integrity or performance of the Services.

5. Third-party services and integrations

The Services may integrate with third-party platforms — including QuickBooks Online (operated by Intuit Inc.) for accounting and invoicing, and email and analytics providers — to deliver functionality such as statements, invoices, and notifications. Your use of those third-party services is governed by their own terms and privacy policies. Bello Homes is not responsible for the availability, accuracy, or content of third-party services, but we will use commercially reasonable efforts to keep our integrations functioning as intended.

We will only access third-party data necessary to deliver the Services to you, and only with appropriate authorization. See our Privacy Policy for details on what we collect and how it flows.

6. Intellectual property

All software, content, branding, and design elements of the Services are owned by Bello Homes or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services solely for the purpose contemplated by your relationship with Bello Homes. No other rights are granted.

7. Your content and data

You retain ownership of any data you submit to the Services (for example, contact information, property details, or files you upload). You grant Bello Homes a limited license to host, process, and use that data solely as needed to operate the Services and fulfill our obligations to you.

8. Statements, invoices, and financial data

Statements, owner payouts, expense allocations, and invoices presented in the Services are generated based on data from booking platforms, expense entries, and our internal records. We strive for accuracy, but figures may be revised when more complete data becomes available (for example, late refunds, chargebacks, or reconciliation adjustments). The authoritative financial record is the version posted by Bello Homes accounting after month-end close.

9. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any specific results will be achieved.

10. Limitation of liability

To the maximum extent permitted by law, Bello Homes will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services. Our aggregate liability for any direct damages is limited to the management fees you paid Bello Homes in the twelve months preceding the event giving rise to the claim, or one hundred U.S. dollars (US$100), whichever is greater.

11. Termination

We may suspend or terminate your access to the Services at any time if you breach these Terms or your management agreement, or if continued access would expose Bello Homes or other users to risk. You may stop using the Services at any time. Termination of these Terms does not by itself terminate your management agreement, and vice versa.

12. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will post the updated version at this URL and update the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Wake County, North Carolina, and you consent to the personal jurisdiction of those courts.
